1. Participation in the Program
To participate, create an affiliate account at www.securehomenetwork.org/affiliates, provide your full name and email, and submit an application. The Company may accept or reject applications at its sole discretion and may terminate your membership or block your use of the SecureHomeNetwork Website for any reason, including non-compliance or engagement in fraudulent or unlawful activities.
If your application is rejected, these Terms terminate immediately, and the Company owes you no obligations.
2. Links and Use of Ads
Upon acceptance into the Program ("Participation Notice"), you will receive a unique Link (HTML code). You may display on your site ("Your Site") the Company's names, trademarks, or advertising materials ("Ads") provided or approved by the Company. All Ads must include the provided Link and be used in accordance with these Terms.
You must not:
- Imply that Your Site is established or maintained by the Company.
- State or imply that you are an authorized representative of the Company.
- Use terms like "official" in reference to Ads.
- Mislead others.
The Company may monitor Your Site and require you to stop using any Link or Ad that is inconsistent with these Terms.
3. Promotion of SecureHomeNetwork Website
You may not use the following methods to promote subscriptions:
- Email SPAM: Do not send bulk unsolicited emails ("SPAM") without prior written consent for each mailing. Emails can only be sent to individuals who have consented to receive them.
- Comment SPAM: Do not post Links or Ads in irrelevant newsgroups, blogs, unsolicited emails, link farms, chatrooms, or guestbooks. Do not use automated bots to post comments.
- Prohibited Content: Do not place Links or Ads on websites with unlawful, harmful, threatening, or objectionable content, or that promote illegal activities.
You may only use coupons, discounts, and promotions provided exclusively by the Company.
Violation of this section is a material breach and may result in termination from the Program and withholding of Commissions.
4. FTC Endorsement Compliance
If you are based in the US, you must comply with all Federal Trade Commission (FTC) regulations regarding advertising, including disclosing material connections between advertisers and endorsers.
5. Processing Subscriptions
The Company will process subscriptions from end users who follow the Link on Your Site to the SecureHomeNetwork Website. The Company reserves the right to reject subscriptions at its discretion.
You will receive reports of sales of Qualified Subscriptions (defined below). You must ensure that the Link is properly formatted; the Company is not responsible for tracking failures due to improper formatting.
6. Qualified Subscription
A "Qualified Subscription" is a subscription by:
- (a) An end user who follows the Link on Your Site to the SecureHomeNetwork Website during the term of these Terms ("End User").
- (b) Who signs up and subscribes using the Company's automated process.
- (c) Who makes full valid payment to the Company.
Subscriptions by reactivated accounts are not considered Qualified Subscriptions.
Expiration/Broken Referral: The tracking cookie expires after 31 days unless extended in writing. If the End User uses another computer, another affiliate's Link, or deletes the cookie before creating an account, you will not receive a commission.
The Program is for commercial use only. You may not subscribe on behalf of others.
7. Commissions
You will earn commissions ("Commission") for each Qualified Subscription that remains active for at least 31 days without chargebacks or refunds. Commissions are paid after 31 days following actual payment by the End User.
- Rates: Default commission rates are displayed at www.securehomenetwork.org/affiliates and may change without notice. Mutually agreed rates prevail over default rates.
- Payment Methods: Commissions are paid via PayPal or wire transfer.
- Minimum Payment: The minimum payout is $50. Payments are sent upon your request within 30 days of the request.
- Responsibilities: You are responsible for any transaction fees and must provide accurate payment information.
The Company may offset commissions against refunds, credits, or chargebacks. If your commission balance falls below zero, your account may be suspended until you repay the negative balance.
Taxes & Charges: You are responsible for all taxes and charges related to your commissions.
Withholding: The Company may withhold or reverse commissions if it suspects fraud, improper activity, or breach of these Terms.
8. Information
You must provide all requested information to receive commissions and update the Company of any changes.
Your personal information may be used to:
- Set up and maintain your account.
- Monitor activities for fraud or breaches of these Terms.
- Contact you regarding your account and future offers.
9. Policies and Pricing
End Users are customers of the Company, and all Company policies apply to them. The Company may change policies, procedures, prices, and availability at any time.
10. Limited License
The Company grants you a limited, non-transferable, revocable license to use its names, trademarks, and Ads solely for displaying on Your Site as specified. You may not modify any materials provided.
The Company reserves all rights and may revoke your license at any time.
11. End User's Data
All personally identifiable information from End Users is the exclusive property of the Company. You may not use or disclose this data.
12. Amendment
The Company may amend these Terms or terminate the Program at any time. Continued participation constitutes acceptance of changes.
If changes are unacceptable, your sole remedy is to terminate your membership by providing written notice or closing your affiliate account.
13. Term and Termination
These Terms become effective upon acceptance into the Program and end upon:
- Your termination by written notice or account closure.
- Program termination.
- Your violation of these Terms or engagement in fraudulent activity.
- Company termination of your membership with 30 days' written notice.
Commissions earned but unpaid at termination remain payable if the related subscriptions are not canceled or charged back and these Terms were not terminated due to your breach.
Sections 10, 12, 15, 16, 17, and 18 survive termination.
14. Responsibility for Your Site
You are solely responsible for:
- Development, operation, and maintenance of Your Site.
- Content accuracy and appropriateness.
- Ensuring content does not infringe third-party rights or violate laws.
- Compliance with all applicable laws, including anti-spam and data privacy laws.
- Proper formatting of the Link to the SecureHomeNetwork Website.
15. Limitation of Liability
Under no circumstances shall the Company be liable for indirect, incidental, special, consequential, or exemplary damages arising from these Terms or the Program. The Company's total liability shall not exceed $100.
16. Indemnification
You agree to indemnify the Company and its affiliates against all liabilities, losses, damages, costs, and expenses arising from:
- Breach of any warranty regarding Your Site.
- Claims that Your Site infringes intellectual property rights, except for claims arising from Company-provided Ads.
- Any act or omission by you or your agents in performing your obligations under these Terms.
17. Disclaimers
The Company makes no warranties regarding the Program or services sold through it, including warranties of fitness, merchantability, or non-infringement. The Company does not guarantee uninterrupted or error-free operation of the SecureHomeNetwork Website or that you will receive any specific volume of commissions.
18. General Provisions
- Independent Contractors: Both parties are independent contractors; no partnership or agency is formed.
- Assignment: You may not assign your rights without the Company's consent; the Company may assign without restriction.
- Communication: Communication will be primarily electronic via the SecureHomeNetwork Website or email. We will use the email or telephone number you provided during registration.
- Governing Law: These Terms are governed by the laws of the State of Wyoming (excluding its conflict of law principles). Disputes shall be resolved exclusively in the courts of Sheridan, WY.
- Severability: If any provision is invalid or unenforceable, the remaining provisions remain in effect.
- Entire Agreement: These Terms constitute the entire agreement between you and the Company regarding the Program, superseding any prior agreements or understandings.
By participating in the Program, you acknowledge that you have read, understood, and agree to be bound by these Terms.
